These terms cover your use of the This Side Up app. Installing or using the app means you accept them.
This Side Up walks you through photographing a package — before you ship it, or right after one arrives — keeps those photos together as one record, counts down the carrier's filing window, and builds a PDF or ZIP you can send when you need to file a claim.
What it does not do. The app does not file claims, does not contact carriers, and does not send anything to your buyer. It has no way to make a carrier accept a claim, and nothing here is legal advice.
The app shows each carrier's filing deadline and required photos, along with the date we last checked that carrier's published rules. Carriers change their terms without telling us. Before you rely on a deadline, confirm it with the carrier. You are responsible for meeting your own deadlines.
You keep everything you create in the app. We claim no rights to your photos or records, and we never receive them — see the Privacy Policy. Because everything lives on your device, keeping it safe is up to you: if you lose or wipe the phone without exporting first, we cannot recover anything for you.
Only photograph what you have the right to photograph, and use the app only for lawful purposes.
The app is free to use for up to three active records at a time. Photos, PDFs, and exports stay free on both plans — paid is about how many records you keep. A subscription raises the limit and adds archiving and batch export.
If a subscription ends, your records stay in the app. You can still open them, export them, and pull anything back out of the archive. What you lose is the ability to create records past the free limit, to move records into the archive, and to export several at once.
The app is provided "as is," without warranties of any kind. We do not promise that it will be uninterrupted or error-free, or that a carrier will accept evidence produced with it.
To the extent the law allows, we are not liable for indirect or consequential damages, including a denied or missed carrier claim, lost sales, or lost data. Where liability cannot be excluded, it is limited to what you paid us in the twelve months before the dispute arose.
Some states don't allow these limits, so they may not apply to you.
These terms end when you delete the app. If you use the app unlawfully or in a way that harms others, your license to use it ends — and we may report it or refuse future sales.
We may update these terms. The date at the top changes when we do, and continuing to use the app after that means you accept the update.
These terms are governed by the laws of the State of Georgia, United States.
This agreement is between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support for it. If the app fails to conform to any warranty, you can tell Apple and Apple will refund what you paid; beyond that, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You may use the app only on an Apple device you own or control, and only as the App Store Terms of Service allow. You confirm that you are not in a country under a U.S. embargo or on a U.S. list of prohibited or restricted parties.
